The Bazaar Shop has been trading since 2014 selling superb quality products. We now provide auctions for both used and pre-owned new items. Anything from high end watches and jewellery to plant & equipment and anything in-between. Exciting new products come into our warehouses daily. Many of the items are without reserve.

Terms and Conditions of The Bazaar Shop Timed Auctions

The ‘Bazaar Shop’ and the ‘Bazaar Shop Auctions’ are trading names of The Evoque Group Limited. Company number 09151348
The Bazaar Shop Auctions timed auctions:
Timed auctions are like live auctions, but there isn’t a ‘live’ auction or auctioneer. Our auctions normally take place over two (2) weeks. This extended timeframe means you can re-submit bids as often as you like up to the closure time should your initial maximum bid be beaten. In this event, you’ll be notified, allowing you to bid again.
Definitions

The following defined terms are used in these Terms and Conditions:

“Auction” means any Auction conducted by The Bazaar Shop Auctions including any internet-based auctions.

"Auctioneer" means The Bazaar

“Bid” means the sum of money ‘offered’ for the Lot by a Bidder placing ‘a Bid’;

“Bidder” means a bidder at an Auction (using the internet);

“Buyer” means the bidder whose bid was the last highest bid when the auction ends.

“Buyers Guide/Catalogue” means any buyers guide information relating to a ‘Lot’ for auction and which may contain additional terms and conditions relating to the sale of that ‘Lot’.

“Conditions” means these terms and conditions including any additional ‘terms and conditions’ annotated in the Buyer’s Guide/Catalogue;

“Consigned Property” means any item consigned by a Vendor to The Bazaar Shop Auctions for offer at an Auction;

"Hammer Price" means the level of bidding reached (at or above any reserve) when the Auction is complete and includes VAT at the prevailing rate unless stated otherwise;

“Lot” means any Consigned Property offered at Auction by The Bazaar Shop Auctions;
"Stated Rate" means The Bazaar Shop Auctions’ published rates of commission for the time being plus value added tax.

"Terms of Consignment" means any stipulated terms and rates of commission on which The Bazaar Shop Auctions has accepted instructions from Vendors or their agents;

"Total Amount Due" means the Hammer Price in respect of the sold Lot together with any premium, commission, value added tax chargeable and any additional charges payable by a defaulting Buyer under these Conditions;

“Vendor” means the vendor of an item on whose behalf The Bazaar Shop Auctions offer Consigned Property for sale by Auction;

“Winning Bid” means the highest bid at the end of the Auction. In the event of two bids for the same amount being the highest bid at the end of the Auction, the Bid submitted first in time will be deemed the Winning Bid.

General

These conditions, together with any additional conditions appearing in the catalogue, are the terms and conditions subject to which The Bazaar Shop Auctions (The Auctioneer) acting as agent for the vendor shall sell goods to the Buyer and all other conditions, whether express, or implied at common law, or by statute, as are capable of lawful exclusion are hereby excluded. By participating in this sale all Buyers agree to be bound by these conditions and are deemed to have read and have full knowledge of them.
Whilst the Auctioneers makes every effort to ensure the accuracy of their Buyers Guide/Catalogue and description of each lot, it does not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition, or quality of any Lot. All goods are sold with faults and imperfections and errors of description and without warranty or Guarantee except as where expressly stated. All statements whether printed in the catalogue or made orally are statements of opinion and are not to be taken as being or implying any warranties or representations of fact. All Bidders should rely on their own judgement as to matters affecting any lot.
Where instructed by the Vendor to ‘certify’ a Lot, The Auctioneer does so as agent of the vendor and is not itself responsible for any statement or assertion within that certification.

Buyer Guide/Catalogue

Buyer Guides/Catalogues are provided for information only and do not form part of these Conditions. They may however contain additional terms and conditions which are deemed incorporated into these terms and conditions.

The Bazaar reserves the right to use any photographs, background information, and research for publicity purposes both before and after the sale.


Bidders and Fees

The Auctioneer shall only accept bids from Bidders who have completed a registration form to the Auctioneer’s satisfaction.
Once a Bid is made it cannot be retracted.
The Bidder shall pay to the Auctioneer a buyers’ premium of 17% inclusive of VAT and any Easylive Commission payable on the sale, all included on the hammer price. The Premium is NOT negotiable and is payable by ALL purchasers.
Bidders using the Easylive bidding platform (and having paid the Easylive upfront fees) will not pay any additional commission, just the buyer's premium of 17% including VAT.
Deposits for exceptional lots maybe requested by the Auctioneer immediately at the fall of the hammer.

Winning Bid/Buyer
Following the end of an Auction, the Bidder of the “Winning Bid” becomes The Buyer and accepts liability for ‘Payment, Title and Collection’ of the Consigned Property comprising the Lot.

Title and Collection of Purchases

The ownership of any purchased Lot shall only pass to the Buyer once payment in full of the Total Amount Due has been received by The Bazaar Shop Auctions (Evoque Group).

Payments by bank transfer will only be accepted through Evoque Groups Barclays Bank Barclaycard payment terminal and any receipt for payment shall be from Evoque Group, not The Bazaar Shop Auctions.
In accordance with Money Laundering Regulations and the Criminal Justice Act of 1993 The Bazaar Shop Auctions cannot accept single cash payments exceeding £9,999.00.
Buyers shall at their own risk and expense take possession of and remove from the Auction premises any Lot they have purchased and paid for no later than 5 working days after the date of the Auction after which they will incur storage, and insurance charges, charged at £5 per day, together with the cost of any removal charges. Items required to be delivered will be charged under the Bazaar Shop Auctions Shipping Policy. Delivery costs must be paid by the Buyer in advance of delivery.

Default by Buyer or Vendor

The Bazaar Shop Auctions act as agent for the Vendor. The Bazaar Shop Auctions is not responsible for any default by either the Vendor or the Buyer.

If any Lot is not paid for in full and removed in accordance with these Conditions or in the event of any other breach of these Conditions, The Bazaar Shop Auctions as agent for the Vendor shall at its absolute discretion and without prejudice to any other rights it may have, be entitled to exercise all or any of the following rights and remedies:

(a) proceed against the Buyer by way of an action for debt or damages for breach of contract;

(b) rescind the sale of that Lot and/or any other Lots sold by The Bazaar Shop Auctions to the defaulting Buyer; and

(c) re-sell the Lot by Auction or private treaty. If a lower Hammer Price is achieved on the re-sale than that achieved on the original sale (after crediting any part payment and adding any re-sale costs) the defaulting Buyer shall be liable for the difference.

(d) remove, store and insure the Lot at the expense of the defaulting Buyer and, in the case of storage, store either at The Bazaar Shop Auctions’ premises or elsewhere;

(e) charge interest at a rate not exceeding 1.5% per month on the total amount due to the extent it remains unpaid for more than 5 working days after the sale date;

(f) retain that or any other Lot sold to the defaulting Buyer until the Buyer pays the total amount due;

(g) reject or ignore bids from the defaulting Buyer at future Auctions or to impose conditions before any such bids shall be accepted;

(h) apply any proceeds of sale of other Lots due or in future becoming due to the defaulting Buyer towards the settlement of the total amount due and to exercise a lien on any of the Buyer's property in the possession of The Bazaar Shop Auctions for any purpose.

Disputes

Any dispute as to the Winning Bid of an Auction shall be determined exclusively by the Auctioneer by application of these terms and in making any Bid, a Bidder accepts the Auctioneer’s decision on this issue.

Any other dispute, including relating to the Consigned Property comprising a Lot, or any dispute between a Vendor and a Buyer which cannot be resolved by negotiation shall be referred to CEDR for dispute resolution (whose determination the parties agree to be bound by) pursuant to the Bazaar Shop Auction Dispute Policy.

Governing Law

All matters arising under the Auctions and these terms and conditions shall be subject to and determined by reference to the Laws of England & Wales.


BAZAAR SHOP AUCTION DISPUTE POLICY

In the event of any dispute arising between any Vendor or Buyer and the Company as regards the services provided under the on-line auction market; or between any Vendor and any Buyer with regards to any issue arising from any auction, such dispute shall be resolved by way of the following dispute resolution procedure:

1. The parties shall attempt in good faith to resolve any dispute or claim promptly through negotiations in good faith. In respect of a dispute between a Vendor and a Buyer the Company will assist such negotiations as a ‘broker’.
2. In the event of any dispute arising between the parties that cannot be settled by negotiation, the parties will in good faith seek to resolve that dispute through mediation. The Company shall refer the matter to CEDR Dispute Services.
3. The parties to the dispute shall thereafter follow the procedure and guidance of CEDR in referring the matter to a mediator and will co-operate with the mediator and the mediation service to resolve the dispute, if possible.
4. If the dispute is not resolved by mediation the dispute shall be referred to arbitration in accordance with the rules of the Chartered Institute of Arbitrators (London), whose rules are hereby incorporated into this procedure.
5. The decision of the Arbitrator shall be binding on all parties and it is agreed that should a party refer the matter to the Courts, this agreement to arbitration and the Arbitrator’s decision shall be adduced in any subsequent Court proceedings.
6. The costs of Mediation and/or Arbitration will be shared equally between the parties unless a mediator/arbitrator deems otherwise.
7. The referral of this dispute to Mediation or Arbitration does not affect the parties’ rights that may exist under Article 6 of the European Convention of Human Rights. If the dispute is not settled by mediation or determined by arbitration the parties’ rights to a fair trial remain unaffected and neither party is prevented from issuing proceedings.
8. A refusal by either party to attempt to resolve the dispute by or to fully partake of mediation and/or arbitration may be founded upon by the other in any subsequent proceedings.
All parties agree that the right to seek and obtain injunctive relief and/or to issue and pursue proceedings for non-payment of the auction price is expressly excluded from the requirement to adopt ADR.
Items weighing under 15kg can be shipped with Royal Mail Tracked for an additional fee of £3.99.

Collections – All collections must be made within a week of the auction completion. Any items that have not been collected after a week will incur a £5 a day storage cost starting from the day after the end of the auction.
