Lanora House Auctions Limited – Buyer Terms & Conditions

Lanora House Auctions Limited – Buyer Terms & Conditions

  1. Definitions

    1. “Lanora House Auctions Limited” (“the Auctioneer”) conducts the sale. “The Vendor” is the person instructing us to sell items.
“The Purchaser” (“the Buyer”) is the successful bidder who agrees to buy goods at auction.

  2. Bidding

    1. All bidders must register their full name and postal address before taking part in any sale. Proof of identity may be requested.
By placing a bid—whether in person, online, or by commission—the bidder accepts and agrees to these Terms & Conditions.

    2. Bid increments are set solely by the Auctioneer. We may refuse any bid at our discretion.
The highest bid when the hammer falls constitutes a binding purchase contract.

    3. If requested, we can place commission (absentee) bids on behalf of buyers at no additional charge.
Items will be purchased as inexpensively as possible, subject to reserves and competing bids.

    4. If two commission bids for the same amount are received, priority is given to the bid submitted first.
Commission bids must always state a maximum amount; unlimited bids will not be accepted.

    5. Buyers are strongly encouraged to inspect items in person before bidding. Commission and telephone bids are placed entirely at the bidder’s own risk.
      All bids exclude buyer’s premium.

    6. All items are sold “as seen.” This includes all faults, defects, wear, imperfections, and any inaccuracies in description.
The Auctioneer accepts no responsibility for the age, authenticity, origin, condition, or quality of any lot.

    7. Commission bids must be submitted by 10:00am on the day of the sale. While every effort is made to execute bids accurately,
the Auctioneer accepts no liability for errors, missed bids, or unforeseen issues.

    8. Telephone bidding may require written confirmation from unknown buyers at least 48 hours before the sale.
We make every reasonable effort to maintain telephone connections, but no responsibility is accepted for missed or disrupted calls.
Telephone bidding is normally not available for lots with a starting bid under £50.

    9. Lots will be purchased for the absentee bidder at the lowest level consistent with reserves and competing bids (excluding buyer’s premium).

  3. Admittance

    1. Lanora House Auctions Limited reserves the right to refuse entry to the premises or to any auction event without explanation.

  4. Buying & Payments

    1. The Auctioneer retains complete discretion over the conduct of the sale and may resolve any dispute or re-offer a disputed lot.

    2. The Auctioneer is permitted to bid on behalf of the Vendor when a reserve price is in place.

    3. No item may be removed until full payment of the hammer price, buyer’s premium, and any applicable charges has been made.

    4. Payment deadline: Buyers must pay all invoices within 48 hours of the sale (or invoice issue, whichever is earlier).
If payment is not received within 48 hours, an additional £1 per day will be added until the balance is paid in full.

    5. All lots must be removed within 10 days of the sale unless alternative arrangements have been agreed.
Storage charges of £2 per day per lot may apply, along with any transport costs.

    6. The Auctioneer is not responsible for loss or damage to items after the hammer falls.
In the event of payment default, we may re-sell the lot and recover losses, fees, and expenses from the original buyer.

    7. If payment remains outstanding after 12 total days, unpaid purchases may be cancelled and re-sold.
Buyers who default may be permanently banned and reported to other auction houses via the Easy Live Auction platform.
Items paid for but not collected within 5 days will accrue storage fees of £2 per day; once fees equal the purchase price,
the item may be re-sold with no refund due.

    8. A bid is a legally binding commitment to purchase. If payment is not made promptly, Lanora House Auctions Limited may cancel the sale,
re-sell the item, charge administrative/legal costs, blacklist the buyer, and/or pursue legal action if necessary.

  5. Selling (Vendors) – Summary for completeness (Included because some buyer terms reference seller processes)

Key points retained but wording altered for originality.

    1. Vendor payments are normally made 14 days after the sale, provided the buyer has paid. Payments may be made by bank transfer or cash.

    2. Vendors confirm they hold full legal title to the items consigned and agree to pay the agreed seller’s commission.

    3. The Auctioneer acts solely as an agent and is not responsible for buyer default.

    4. All items are sold exactly as they appear, with no guarantees regarding authenticity, age, origin, or condition.

    5. e–h. The Auctioneer may amend descriptions, seek compensation for breaches, and apply disposal or re-entry conditions for unsold items. Unsold lots must be collected within 5 days unless alternative arrangements are agreed.

  6. Droit de Suite (Artist’s Resale Right)

    1. A royalty may be payable on qualifying artworks sold for €1,000 or more. The buyer is responsible for all ARR fees, which scale downward as the price increases.
These fees are not subject to VAT. Lots may be marked “ARR”; however, buyers remain responsible for checking applicable laws.

  7. General Conditions

    1. If a member of the public damages a lot, we may:

      1. Sell the item without reserve and charge the difference.

      2. Charge the cost of restoration.

      3. Charge the full reserve or lower estimate.

    2. Lanora House Auctions Limited may amend these terms at any time without notice.
Continued use of our services constitutes acceptance of the latest terms.

  8. Third-Party Liability

    1. Visitors enter the premises at their own risk and must take reasonable care for their own safety.

    2. We accept no responsibility for loss, injury, or damage to individuals or property before, during, or after the auction
except where it results from proven negligence by Lanora House Auctions staff.

    3. All vehicles on-site are parked at the owner's risk.

  9. Bidding Increments

    1. Bid increments are determined solely by the Auctioneer.

  10. Condition & Description of Lots

    1. While every effort is made to describe items accurately, exhaustive checks are not always possible.

    2. Buyers are responsible for examining lots before bidding.

    3. Viewing opportunities are provided specifically to allow buyers to satisfy themselves regarding condition and description.

  11. Delivery & Postage

    1. Delivery quotes must be requested before bidding.

    2. All packing is carried out at the purchaser’s risk. We can provide postage receipts to support customer claims.

    3. Items are normally dispatched within 10 days of payment.

    4. Items packed for courier collection may incur a per-lot charge and remain entirely at the buyer’s risk once collected.
