Terms and Conditions of Sale

These Terms and Conditions apply to all users of Auction Cash and to all buyers and sellers participating in auctions conducted by Auction Cash.

All online bidding is conducted through the Easy Live Auction platform.

By registering to bid, placing a bid, consigning goods, or participating in an auction you agree to be bound by these Terms and Conditions and by the terms of the Easy Live Auction platform.

Auction Cash reserves the right to amend these Terms and Conditions at any time. The current version will always be available on the website.

Definitions

Auction Cash refers to the business operating the auction.

The Auctioneer refers to the person conducting the auction on behalf of Auction Cash.

The Buyer refers to the person placing bids and purchasing goods at auction.

The Vendor or Seller refers to the person or business consigning goods for sale.

A Lot refers to any individual item or group of items offered for sale.

The Hammer Price refers to the final price accepted by the auctioneer when bidding closes.

Online Bidding

All auctions are conducted online through the Easy Live Auction platform.

Bidders must register with Easy Live Auction in order to participate.

By placing a bid through Easy Live Auction the bidder enters into a legally binding agreement to purchase the lot if they are the successful bidder.

The highest bid accepted by the auctioneer will be the buyer.

In the event of a dispute the auctioneer has the right to settle the matter or reoffer the lot.

The auctioneer has the right to refuse any bid, withdraw any lot, divide lots, combine lots, or regulate bidding as necessary.

The auctioneer’s decision is final.

Buyer’s Premium

A buyer’s premium of 20 percent is charged on the hammer price of all successful bids.

Where bidding takes place through Easy Live Auction additional platform charges may apply depending on the bidder’s Easy Live Auction account settings or subscription options.

The buyer is responsible for any Easy Live Auction platform fees.

Payment

Successful bidders must complete payment within the timeframe stated on the invoice.

The purchase price consists of the hammer price plus the buyer’s premium and any applicable Easy Live Auction platform fees.

Payment instructions will be provided following the auction.

Auction Cash reserves the right to cancel the sale or suspend the buyer’s account if payment is not received within the required time.

Ownership of goods will not pass to the buyer until payment has been received in full.

Risk for the lot passes to the buyer at the fall of the hammer.

Collection of Goods

Buyers are responsible for arranging collection of their purchases.

Collection details and times will be communicated after the auction.

Buyers must check all items at the time of collection.

Once goods have left the premises Auction Cash cannot accept responsibility for missing items, damage, or loss.

Where goods are collected by a third party they will be considered to be acting on behalf of the buyer.

Shipping and Delivery

Auction Cash may offer packing or shipping services for certain items where possible.

Additional charges may apply.

Buyers may arrange their own courier if preferred.

Auction Cash accepts no responsibility for loss or damage once goods have been handed to a courier or have left the premises.

Storage

Items must be collected within the stated collection period unless prior arrangements have been made.

Items not collected within this period may incur storage charges.

Where items remain uncollected for an extended period and no communication is received from the buyer, Auction Cash reserves the right to resell or dispose of the goods to recover costs.

Condition of Goods

All lots are sold as seen.

Descriptions, photographs, and condition reports are provided as a guide only.

Buyers must satisfy themselves as to the condition, authenticity, and suitability of any item before bidding.

Neither the seller nor the auctioneer guarantees the accuracy of statements relating to authorship, origin, date, age, attribution, genuineness, provenance, or condition.

Neither the seller nor the auctioneer accepts responsibility for faults, defects, or imperfections in any lot.

Viewing

Where viewing is available buyers are encouraged to inspect items before bidding.

Condition reports may be provided where possible but these are opinions only and should not be treated as guarantees.

Vendor Terms

Vendors consigning goods for sale agree that Auction Cash may photograph, catalogue, advertise, and sell their items.

Auction Cash reserves the right to determine how items are grouped into lots and presented in the auction.

Vendor commission and charges will be agreed before goods are accepted for sale.

Vendor payments will normally be made once the auction has completed and buyer payments have cleared.

Liability

Auction Cash accepts no responsibility for loss, damage, or injury occurring on the premises unless caused by proven negligence.

Auction Cash is not responsible for technical interruptions affecting online bidding on the Easy Live Auction platform.

Where liability is established it will not exceed the hammer price of the lot concerned.

Website and Platform Use

Users must provide accurate information when registering for auctions.

Users must not attempt to interfere with the auction process or manipulate bidding activity.

Auction Cash reserves the right to suspend accounts that breach these rules.

Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms and Conditions will be subject to the jurisdiction of the courts of England and Wales.

Shipping is available at the buyer’s request.

Items can be sent using Royal Mail First Class, with the option of Signed For or Tracked delivery if preferred.

Shipping is charged at the exact Royal Mail rate we pay, with no additional packing or handling fees.

The buyer is responsible for all shipping costs.

Larger items, mixed lots, or bulky goods may require collection or a courier arranged by the buyer.

Once items have been dispatched and handed to Royal Mail or a courier, delivery is at the buyer’s risk. Auction Cash cannot accept responsibility for delays, loss, or damage during transit.

Buyers are welcome to arrange their own courier or collect items in person if preferred.
