1.1 All lots purchased are subject to a Cedar Auctions buyers premium of 16.6% plus VAT which is added to the hammer price. Easy Live Auction adds a registration fee of a flat £3, or 3% plus VAT, (the choice being the bidders) added to the hammer price.

1.2. Descriptions of Lots are intended to help the auctioneer differentiate between lots. Bidders should satisfy themselves about lots, and photographs form part of the description. Additional photos can be supplied on request up to 36 hours before the auction. Please see also section 8.

1.3 Bidders should read the Auction Terms and Conditions prior to bidding at auction, as Bidders and Buyers will be deemed to have accepted these terms and conditions once a bid has been placed.

1.3 We act as agent for the Seller. If a Buyer is the successful Bidder on the fall of the hammer, the contract of sale is made directly between the Buyer and the Seller.

2.1 Pre-sale estimates may allow Bidders gauge approximate prices for the purchase of a particular Lot. The actual Hammer Price realised at auction may be higher or lower than the pre-sale estimate. A reserve price may have been agreed with the Seller below which the lot will not be sold. Pre-sale estimates do not include the Buyers Premium

2.2 The Purchase Price is due and payable when the Lot is sold, unless otherwise agreed in writing by us. An invoice will be sent to the Buyer by email, and Buyers may be telephoned or otherwise contacted when payment is not received promptly or where there are queries in any respect. Buyers are responsible for providing a clear current email address.

3.1 Bidders must register for each auction via Easy Live Auction.

3.2 The Bidder with the highest bid accepted by us, (subject to reserves) shall be the Buyer at the Hammer Price.

3.3 Lots will only be invoiced to the name and address and email of the Bidder and we can only accept payment for the Lot from the registered Bidder. We retain the right to withdraw or re-offer any Lot if we believe there has been an error or dispute. Any dispute about a Bid shall be settled at Cedar Auctions absolute discretion, always acting reasonably.

3.4 It is the responsibility of the Bidder to ensure that Bids are made accurately. We are not responsible for any technical failure or otherwise which results in bids not being received.

4.1 Title in a purchased Lot is retained by the Seller and shall only pass to the Buyer when the Purchase Price and all other sums payable by the Buyer have been received by Cedar Auctions in full and cleared funds.

4.2 Risk for the Lot passes to the Buyer at the time the Lot is sold to the Buyer. Cedar Auctions is not responsible for loss or damage to any Lot at any time.

5.1 Once payment of all sums due have been received in full and cleared funds, we will release the Lot to the Buyer. PLEASE NOTE that the lots are located in the UK.

5.2 Cedar Auctions currently offer an international packing and shipping service. Charges will be advised in the initial invoice. We utilise this service for all lots unless, at the the auctioneers discretion, packing and/or shipping would be impractical, when collection can be arranged by contacting Cedar Auctions within three working days of the auction for an appointment, subject always to payment being received in full by us.

5.3. We do not insure Lots in transit, other than any base insurance level offered by the courier firm.

6.1 If the Purchase Price and/or all sums payables are not paid in full when they fall due we will without further notice to the Buyer be entitled to exercise one or more of the following rights:
to terminate the agreement for sale immediately.
to remove and/or store the Lot at the Buyer's expense.
to take legal proceedings against the Buyer on behalf of the Seller for payment of any sums due.
to release the name and address of the Buyer to the Seller to enable the Seller to commence legal proceedings to recover the amounts due and legal costs. We will take reasonable measures to notify the Buyer prior to releasing such details to the Seller.
to charge interest on any monies due at the annual rate of 8% per annum from time to time to be calculated on a daily basis from the date upon which such monies became payable until the date of actual payment.
to sell the Lot without a Reserve Price at auction and apply any proceeds against the amount owing by the Buyer.
to apply any monies received from the Buyer in payment or part payment of any sums due from the Buyer under these Terms; and/or
to refuse to allow the Buyer to register for a future sale or to reject any future Bid made by the Buyer.

6.2 We shall, as agent for the Seller and on our own behalf pursue these rights and remedies only so far as we deem at our sole discretion is reasonable to make appropriate recovery in respect of breach of these Terms and Conditions. We are in no way obligated to exercise any of the above rights or remedies.

7.1 Neither Cedar Auctions nor the Seller is liable for any errors or omissions provided to Bidders, whether orally or in writing, whether negligent or otherwise.

7.2 Neither Cedar Auctions nor the Seller gives any guarantee or warranty to the Bidder. Any implied warranties and conditions are excluded (except where such warranties and conditions cannot be excluded by law).

7.3 Neither Cedar Auctions nor the Seller accepts responsibility to any Bidder for acts or omissions (whether negligent or otherwise) in relation to the conduct of any auction.

7.5 Any claim by a Bidder or a Buyer against Cedar Auctions or the Seller is limited to the Purchase Price in respect of the relevant lot and shall not include under any circumstances indirect or consequential losses.

7.6 Nothing in these Terms and Conditions shall limit or exclude our liability that cannot be excluded or limited by English law.

8.1 Cedar Auctions reserves the right to alter these Terms and Conditions at any time. Terms under Payments and Shipping are also included within these terms and conditions

8.2 All images and other materials produced for the auction are the copyright of Cedar Auctions

8.3 Lots are offered as seen in the listing and it is the responsibility of Bidders to make any enquiries before the auction date and satisfy themselves as to the accuracy and authenticity of any Lot and in relation to the description of any Lot, including but not limited to a Lots condition, quality, provenance, authenticity, background, style, period, age, origin, value and estimated selling price. If contacting Cedar Auctions on such matters, please do so at least 36hrs before the auction.

8.4 The majority of lots offered by Cedar Auctions are pre-owned, and not necessarily pristine. Use of the condition reference "excellent" does not mean that an item is as new and totally unblemished. Neither does it take into account any small internal manufacturing defects. Neither does it mean that an item has not been re-polished. Any obvious defects will mean that the description "excellent" will be replaced with other terms such as poor, good or very good.

8.5 All dimensions of Lots are approximate and are for general guidance only. A single dimension given is normally the greatest dimension (usually base diameter)for the Lot.

8.6 Subject to the conditions set out in this clause, Cedar Auctions exercises reasonable care when making statements of opinion consistent with its role, based on information provided by the Seller, available scholarship, and the generally accepted opinions of relevant experts (at the time any such expert expressly states such opinion). We are in no way required to seek the opinion of any expert outside Cedar Auctions.

8.7 It is the Bidders sole responsibility to identify and meet any necessary fees, duties or licenses for a Lot, including but not limited to export and import charges applying in their jurisdiction.

8.8 We reserve the absolute right to withdraw any Lot from sale for any reason.

9.1 Should the buyer wish to return a lot, they must contact Cedar Auctions to discuss this, as we are not obligated to accept such returns, but will not act unreasonably. Shipping cost for any such returns will not be paid by Cedar Auctions.
SHIPPING

Cedar Auctions offers an In-house International shipping service for all lots, except where the nature of the lot (at auctioneers discretion) makes this is impractical, when collection may be arranged by the Buyer by contacting Cedar Auctions within three working days of the auction for an appointment. Any Buyers courier must provide evidence of permission and instruction to collect.
Shipping by Cedar Auctions will be assumed to be the default option for all bids. Charges for this service will be as reasonable as possible. Such charges currently include £2.50 plus VAT per item, to cover packing, using quality materials, plus an estimated charge for courier delivery using a competitively-priced reputable firm.
Multiple items in one lot will be charged packing at £2.50 plus VAT per item, but an allowance or discount will be applied as numbers of items increases at the auctioneers discretion. .
The auctioneers do no include any element for insurance, other than any base level included by couriers, and we are not liable for any loss or damage in transit.
Delivery will not be made to a box office address.
Buyers will be invoiced with this packing and shipping cost detailed alongside the Hammer price, Buyers premium, and any Easy Live Auction charge as soon as possible after the finish of the auction, with bank details for payment. A payment link will be supplied within 48hrs of first invoice for those who wish to pay by credit or debit card. Purchased goods cannot be stored for longer than 10 days.
