Terms and Conditions – BUYER & SELLER
The buyer & seller is deemed to have accepted these Conditions of Sale and Notices by the making of any bid.
Please Note, payments will only be accepted via Bank Transfer ONLY! for ALL Lots. No over the phone payments, physical card or cash will be accepted for these Lots.

1. Smiths Auctions make every effort to ensure the accuracy of their catalogue description of any lot & any images published, it is the Bidders’ responsibility to ensure they are content with the quality, content, condition & authenticity of any lots prior to bidding. Any statements made regarding any items, either in the catalogue or orally, must be deemed as being opinion only & do not imply any warranties or representations of fact by the Proprietors of Smiths Auctions.
2. Viewing the sale items is available by appointment ONLY! at our premises anytime from 10am till 4:45pm on the day before the sale.
3. The Auctioneer has absolute discretion to divide any lot, combine any two or more lots or to withdraw any lot or lots from sale, to refuse bids, regulate bidding, to cancel the sale without giving any notice or reason.
4. The Auctioneer will bid on behalf of absentee bidders (COMMISSION BIDS) up to the maximum indicated by the bidder.
5. Unless previously instructed by the Vendors, the Auctioneer may sell items without reserve if they see fit.
6. The highest bidder shall be the buyer, except in the case of a dispute. If a dispute arises, it shall be settled at the Auctioneers discretion or offered for resale.
7. The Auctioneer shall regulate bidding at his own discretion.
8. Bids will ONLY be accepted from registered buyers.
9. By placing a bid, each buyer acknowledges that he has satisfied himself fully by inspection of the goods offered prior to bidding. Electrical or petrol driven items are sold on an “as seen” basis; NO WARRANTIES given or implied.
10. Each lot shall remain the Vendors risk until the fall of the hammer, where risk is transferred to the Buyer; items to remain within the saleroom until paid for in full.
11. Legal title will not pass until lots are paid for in full.
12. If any person makes a successful bid & fails to pay for that item within 7 days of the auction, then that person will be barred from future sales.
13. Lots shall be paid for in full & removed from the saleroom at the Buyers risk & expense by 4.45pm on the day following the sale. For any lots uncollected by this time, the Buyer shall incur charges of £5 per lot per day for storage until removed.
Failure to collect any lots within 14 days & settle any storage fees will incur a ban from all future sales & the items will be forfeited; no refunds will be made & the items will be considered settlement of outstanding fees.
14. COLLECTION – The purchased lots must be arranged for collection for the day after the sale.
15. SHIPPING - We can recommend a shipping courier to collect & deliver at the buyer's cost (To be agreed prior).
16. Each lot shall attract a minimum starting bid of no less than £5 This is at the discretion of the auctioneer.
17. Every person on Smiths Auctions premises at any time shall be deemed to be there at their own risk and shall have no claim against Smiths Auctions in respect of any injury he/she may sustain or any accident which may occur. Smiths Auctions shall have the right at their discretion to refuse admission to their premises to any person.
18. The Seller authorizes Smiths Auctions to deduct Commission at the rate and to retain the Buyer's Premium payable by the Purchaser. VAT will be added to the Commission charge if applicable.
19. COMMISSION RATES & CHARGES
Lotting/Administration Fee – £1.50 per lot, whether sold or not. VAT will be added if applicable.
15% Commission Sale Fee will be added to the hammer price of all lots sold. VAT will be added if applicable.
18% Buyer's premium will be added to the hammer price of all lots purchased, with a minimum charge of £2. VAT will be added if applicable.
20. ONLINE BIDDING - Any lots purchased via easyLiveAuction.com will be subject to an additional 3% commission charge + VAT of the hammer price.
21. RESERVES – Reserves of under £50 will not be accepted on any lot and any unsold reserved lots will incur the minimum commission charge.
Lots failing to reach their reserve may at the entire discretion of the Auctioneers be re-offered in another sale without reserve.
22. The Seller will indemnify Smiths Auctions, its Servants and Agents and the buyer against any loss or damage suffered in consequence of a breach of this condition.
