Welcome to Church Street Auction, Tewkesbury
Church Street Auction are situated in the Cotswold town of Tewkesbury, Gloucestershire site of the battle of Tewkesbury in 1471. Just a few miles off the M5 and M50 motorways within easy reach of Cheltenham, Gloucester, Malvern and Worcester.

We hold general sales ever month and specialist sales for toys and collectables during the year, dates will be posted on the website.
Viewings are held the day before the auction (10am to 6pm) unless otherwise stated.


Church Street Auction Terms and Conditions

Buyers and sellers are advised to read carefully the following conditions of business
Third Party Liability
All persons on the Church Street Auction premises at any time are there entirely at their own risk. They shall have no claim against the auction in the event of any injury.

Church Street Auction act only as an agent for the seller and makes no representation and give no warranty as to the authenticity, merchantability or otherwise of any lot.

2 The Buyer
(i) The buyer shall be the person making the highest bid which is acceptable to the auctioneer
(ii) Church Street Auction has the sole discretion to decide whether a bid has been made
(iii) Every bidder acts as principle

3 Buyers Premium
The buyer of any lot shall pay Church Street Auction a premium equal to 20% plus VAT at the standard rate. The Buyer shall make no deductions in respect of the purchase price, nor will they sell, transfer or otherwise dispose of any lot prior to the payment of the purchase price

4 Payment and Risk
At the fall of the hammer:-
The risk of loss or damage to the lot shall become the full responsibility of the buyer, not withstanding that it may not have been passed to the buyer
Legal and beneficial ownership of a lot shall not pass to the buyer until payment for the lot, along with any other outstanding sums payable, has been made

Methods of Payment
(i) Cash Sterling
(ii) Debit Cards. We accept all major debit cards in person only
(there are no charges for transactions of this nature)
(iii) Bank Transfer – bank account details will be on internet bidder’s invoice

5 Collection of Purchases
(i) At Church Street Auction’s discretion, lots may be removed during the auction. No lot may be removed until the purchase price has been paid in full
(ii) The buyer shall remove from the Church Street Auction premises at his/her expense, any lot purchased by him/her, by 16:30 of the Wednesday following the sale.
(iii) The buyer shall be liable for a storage charge of £5 per item per day if a lot is not removed in accordance with condition 5(ii)
(iv) Church Street Auction shall not be responsible for any damage caused to any lot after the fall of the hammer.
(v) The buyer is responsible for arranging all packing and collection. Church Street Auction shall not be responsible for any loss or damage to any lot, however caused
(vi) Collection By Agents. If an agent or carrier is collecting goods on behalf of the buyer, we require the buyer to supply the name of the agent or carrier before items will be released

6 Conditions of Lots
(i) All catalogue descriptions, verbal descriptions and advertising for sales concerning attribution, genuineness, authorship, origin, period, date, age, provenance, quality or condition, are statements of opinion only and are not to be taken as statements of fact nor the basis for any warranty or guarantee. Many lots will be of an age that precludes them from being in perfect condition and purchasers should satisfy themselves as to the condition of any lot by examining the lot prior to the auction.
(ii) All conditions, warranties, terms, undertakings and obligations implied by statute, common law, custom, trade usage or otherwise, are hereby excluded.

8 Commission Bids
(i) Church Street Auction will, if instructed in writing, execute bids on behalf of buyers. It’s employees or agents, will not be liable to the buyer or seller for any neglect or default so doing or for the failure to do so. Any instruction so given shall be deemed to be irrevocable unless otherwise agreed with by Church Street Auction at any time prior to the auction
(ii) Commission bids will be dealt with in strict order of receipt, therefore, when two or more bids of the same amount for the same lot are received, the first commission bid received shall be the buyer if the bid is successful.
(iii) The room shall take precedence over commission bids

9 Photographs
The buyer gives Church Street Auction the absolute right to use any photograph or illustrations of any lots at any time and in any way at Church Street Auction’s discretion whether or not in connection with any auction. The Copyright in all illustration and written matter relating to lots remains at all times the absolute property of Church Street Auction

10 Online Bidding
Live online bidding by will incur an extra 3% +VAT Unless selecting the £3 Flat Fee option in which case no 3% Internet surcharge shall be applied). Please note this is separate to any other auction house fees.
We do not offer a packing or shipping service at this time.
We are, however, prepared to post small non breakable items such as jewellery, medals or similar via Royal Mail Special Delivery – Please contact auction house to discuss additional costs

Customers are more than welcome to collect items in person

Payment must be received in full before any goods are released

All items must be removed from the auction house by 16:30 on the Wednesday following the sale
