Adams Auctions Ltd - Vendors conditions of sale [by selling or bidding in our auctions you agree to adhere to these terms).
All goods accepted by Adams Auctions ltd will be subject to the following terms and conditions.
1. Adams Auctions Ltd has a varied commission rate which is subject to alteration from time to time. Our present standard rate for all items for sale is 15% at standard rate, with a minimum charge of £1 per lot whether sold or unsold.
2. WARRENTY OF TITLE.
A) The vendor guarantees Adams Auctions Ltd and the purchaser that he/she is the true owner of the goods or is legally authorised to sell the item on the true owner’s behalf and that all such goods are free from any third party claim.
B) The vendor will indemnify Adams Auctions Ltd, its servents & agents against any loss or damage incurred in consequence of a breach of (A) above.
As Adams Auctions Ltd are auctioneers, all items delivered to their premises will be deemed to be delivered for sale by the auction unless otherwise stated in writing. All goods will be entered into those sales which Adams Auctions Ltd consider the most suitable and sold at the auctioneer's discretion.
Unless instructed otherwise [in which case the goods remain at the vendor's or consigner's risk) goods will be insured by the vendor against all risk whilst on the premises pending the sale. ln no event will Adams Auctions Ltd be liable for damage to any item. Adams Auctions Ltd shall not be responsible for damage to, or the loss, theft or destruction of any goods not so insured. if the vendor or consigner has in force a policy or policies of insurance of and shall him/herself note the auctioneer's interest as bailee in such policy or policies.
Adams Auctions Ltd reserve the right to store any goods delivered to them for sale either on their own premises or elsewhere at their sole discretion. Adams Auctions Ltd reserve the right to make a minimum storage charge of £2 per lot per day.
6. RlGHT TO SELL.
Vendors may be charged a minimum fee of £2 per lot per day for any goods left on Adams Auctions Ltd premises after the vendor has been asked to remove them either verbally or in writing. If such goods are not removed within 14 days after such request, Adams Auctions Ltd reserve the right to sell such goods without further notice at their absolute discretion to defray their costs and charges.
7. All goods are offered for sale without reserve unless written instructions are received by Adams Auctions Ltd prior to the commencement of the sale. A reserve once placed cannot be changed without full consent of Adams Auctions Ltd.
Reserves placed by telephone are accepted at the sole risk of vendor and must be confirmed in writing to be received at least one hour prior to the commencement of any sale. Reserves are subject to auctioneer’s discretion of 10% or one bid, whichever is the greater. No reserve will be accepted where the lot is of the value of £30 or less.
The vendor will indemnify Adams Auctions Ltd against any claims in connection with any goods sold on the vendor’s behalf made by a third party howsoever arising.
9. The vendor authorises Adams Auctions Ltd to deduct commission and expenses at the agreed rates from the price realised and acknowledge the right of Adams Auctions Ltd to retain all premiums payable by the purchaser.
Adams Auctions Ltd disclaim responsibility for any default by either vendor or purchaser as they act solely as agents. Adams Auctions Ltd disclaim liability for paying the vendor until full payment is received from the purchaser.
11. RlGHT TO PHOTOGRAPHS AND ILLUSTRATIONS.
The vendor gives Adams Auctions Ltd full authority to photograph or illustrate any lots placed in their hands for sale and to use such photographs or illustrations at their absolute discretion, whether or not in connection with the auction.
Adams Auctions Ltd will reserve the right to make a discretionary charge for any photographs used in the catalogue or supplied to prospective buyers which will promote the items sale.
