A7 Waverley Auctions Ltd – Terms & Conditions of Business
1. The Auctioneer
The person conducting the auction on behalf of A7 Waverley Auctions Ltd (referred to throughout as “the Auctioneer”) acts as agent for the seller.
While every effort is made to ensure catalogue descriptions and lot details are accurate, all items are sold as seen, with any faults, inaccuracies, or imperfections. A7 Waverley Auctions Ltd does not guarantee the authenticity, origin, age, condition, or quality of any lot unless explicitly confirmed in writing by the seller. Any such confirmation is provided strictly in the capacity of agent.
All descriptions—whether written or spoken—are statements of opinion and should not be interpreted as factual guarantees.

2. Bidding
The Auctioneer reserves full discretion to:
• Refuse or accept bids
• Withdraw, divide, or combine lots
• Re-offer items in the event of disputes
• Set bidding increments
• Cancel or amend the sale without prior notice
Bidding on behalf of the seller may occur up to any reserve price.
Bidders are required to register before bidding and to satisfy any security arrangements before entering the auction room to view or bid.
The highest accepted bid forms the sale, except where a dispute arises. In such cases, the Auctioneer’s decision is final.

3. Liability & Default
A7 Waverley Auctions Ltd acts solely as agent and is not responsible for default by buyers or sellers.
Telephone instructions are accepted at the vendor’s risk and must be confirmed in writing.
All visitors to the premises do so at their own risk. No liability is accepted for injury, loss, or damage unless caused by proven negligence by A7 Waverley Auctions Ltd staff members.

SELLERS
4. Authority to Sell
By submitting goods, the seller:
• Confirms acceptance of these terms
• Grants authority to A7 Waverley Auctions Ltd to list and sell the item
4.1 Ownership
The seller guarantees they:
• Own the goods or are authorised to sell them
• Can transfer clear legal title free from claims, or legal disputes that would prevent a sale
Proof of authority may be required, per request from A7 Waverley Auctions Ltd.
4.2 Off-site Goods
If goods are not held by the auction house, the seller must ensure they are available and ready for delivery when requested.
4.3 Accuracy of Information
All information provided must be accurate to the seller’s knowledge.

4.4 Seller Fees
• Commission: 18% + VAT of hammer price
• Insurance 1.5% + VAT on hammer price
Catalogue Fees:
• £2 + VAT per lot

5. Right to Sell Uncollected Goods
Items not collected within 7 days of request may be sold to recover costs, including storage.

6. Risk & Insurance
• Goods remain at the seller’s risk until received
• A7 Waverley Auctions Ltd is not liable for loss or damage unless caused by negligence
• Property is covered by insurance and a charge of 1.5% of the hammer price plus VAT is made to the seller. The value of goods so covered shall be to a maximum of their net auction value
• No liability is accepted for glass/frame damage or repair-related depreciation

7. Reserves
• Items are sold without reserve unless agreed in writing, at least 24 hours prior to sale
• The Auctioneer may accept bids within 90% of reserve unless instructed otherwise

8. Indemnity
The seller agrees to indemnify A7 Waverley Auctions Ltd against any claims relating to the sale.

9. VAT (Sellers)
Business sellers must declare VAT status and registration details before sale.

10. Deductions
The auction house will deduct all agreed fees, commissions, and expenses from sale proceeds.

11. Images & Marketing
The auction house may photograph and use images of items for promotional purposes.

12. Payment to Sellers
Payment is made within 14 days, subject to receipt of funds from the buyer.
If the buyer fails to pay, the lot may be resold.

13. Sale Cancellation
If a sale is rescinded (e.g. forgery claim), refunds may be issued and funds reclaimed from the seller if already paid.

14. Withdrawals
Withdrawal fees apply:
• 18% of reserve or estimate (+ VAT)
Items must be collected within 2 working days or storage fees apply.
Any legal or expert costs relating to ownership disputes are payable by the seller.
Goods cannot be withdrawn after the sale has been published online

15. Unsold Items
Unsold lots may:
• Be offered privately
• Enter future auctions (at auctioneer’s discretion)
After two failed sales:
• Items must be collected within 7 days, the Auctioneers reserve the right to dispose of unsaleable lots following this
• Storage/disposal fees may apply

BUYERS
16. Inspection
Buyers are responsible for satisfying themselves regarding condition, authenticity, and description before bidding.

17. Ownership & Risk
• Ownership transfers only after full payment
• Risk transfers at the fall of the hammer
Failure to pay may result in resale.

18. Buyer Status
All bidders are treated as principals unless prior written agreement confirms agency.

19. Disputes
The Auctioneer’s decision is final in determining the successful bidder.

20. Collection
• Items must be paid for and collected within 5 working days unless agreed
• After 7 days, items may be resold
• Storage charges apply after 2 days unless agreed
Accepted payments:
• Cash, card, bank transfer (BACS), Cheque
Postage Requests
Shipping must be requested promptly. Storage fees apply after 2 days if unpaid.

21. Buyer’s Premium
• 20% + VAT added to hammer price

VAT applies where indicated in the catalogue.

23. Bids
Written, email, or telephone bids may be accepted but are submitted at the buyer’s risk.
If identical bids are received, priority is given to the earliest.
Bidders using online platforms acknowledge that the Auctioneer is not responsible for any loss of connection or technical errors during the sale

Forgery Claims
• Must be submitted within 14 days
• Supported by expert evidence
• Item must be returned in original condition
Refunds are limited to the purchase price only.
