General Auction Information and Terms and Conditions Of Sale.
Grove Mill Auctions retains the right to change any information within these Terms and Conditions without giving due notice.

Grove Mill Auctions have decided for now to keep the sale room closed for customers to come and bid in person. This is because of the space available for customers to be able to feel comfortable.
PLEASE READ THE PARAGRAPHS BELOW BEFORE PROCEEDING TO REGISTER FOR THE SALE

Section 1: VIEWING
The general public are now allowed into the saleroom for viewing only. We are now offering virtual viewing service using Messenger and WhatsApp on our mobile phone 07487 589260. We do encourage you to either come and view or use our new virtual viewing so you can be happy with the item/s that you are interested in bidding on. What we think is good and what you think is good may be poles apart. Please remember this is an auction and that is why a viewing service is offered so it’s up to you the buyer to be sure what you are buying.

Section 2: BIDDING/BUYERS PREMIUM
We are NOT allowing the general public into the auction room to bid at present. We feel this is not practical, you will still need to bid live online, we are still accepting commission bids as normal and telephone bid services may be accepted also, please contact the office to arrange.
Our buyer’s premium is 18.50%

Section 3: PAYMENT
Please note that we no longer accept card payments our preferred method of payment is by bank transfer - our sort code and the account number is on the invoice you receive.
We also accept cash when you come and collect your items.
All payments must be made before the end of business on the Wednesday after each sale.
Below are the available times
Tuesdays after the sales from 12.00pm to 5.30pm (by appointment only)
Wednesdays from 8.00am to 5.30pm (by appointment only)
Also at the Auctioneer's discretion on Monday from 9am to 12pm (subject to prior arrangement)
All lots purchased must be paid for before the end of business on the Wednesday after the sale. Failure to do this will incur a 10% late payment charge per day.

All items must be paid in full, if not the items will be removed, and the Bidder will gain a suspension leading to a ban.


Section 4: COLLECTION OF GOODS/SENDING OF GOODS/STORAGE OF GOODS
We are still going to continue using the collection method that we put into place during the covid restrictions. So, you will still have to contact us to book a pickup slot.
We are still offering a pack and send service but please be aware that this is a service that we offer for a fee, it is Not compulsory, you can always arrange for your items to be packed(for a fee) and sent to you using a method of your choice, but the timing must adhere to our hours of business.
If you require our pack and send service, please request through the bidding platform portal by 5.30pm on Tuesday after the sale. The promptness of your request for delivery will guarantee your delivery is despatched within 24 hours of the end of the sale. A quote will then be sent to you A.S.A.P. We will pack your items for a fee which will be included in your delivery fee.
All items need to be removed from the saleroom within 24 hours of the auction unless special arrangements have been made with ourselves. That includes picking items up by the customer, having a third party pick the items up, or having the items sent to you.
Any items left at the saleroom after 7 days, if special arrangements have not been made, will occur a £1.00 per lot per day storage charge.
If the storage charges are not paid then the items will be sold and the storage charge will be deducted from the sale. Any monies left will then be sent to the original buyer.

Grove Mill Auctions ACCEPTS NO RESPONSIBILITY FOR ANY ITEMS THAT HAVE BEEN BOOKED BY THE BUYER ONCE A COURIER HAS COLLECTED THEM. IT IS UP TO THE BUYER TO TRACK THESE ITEMS AS PER THEIR OWN ARRANGEMENTS WITH THE COURIER.

Section 5: VENDORS/GOODS IN/PAYMENT/SELLERS CHARGES
Payments to our sellers will be made in cash on the Wednesday, a week after the sale.
Vendors will need to contact us for times and dates when you can bring your items to us.
We can offer a pick up service for larger items, prices for this will be available on request.
We will charge you a very competitive 17.5% seller’s commission for your un-reserved items as well as a lotting up fee of .50p per lot
If you want your item/s selling with reserves, there will be an administration charge of £1.00 if the item/s does Not sell.

Section 6: GENERAL UNDERTAKINGS
The Auctioneer acts as agent for the vendor and reserve the right to bid on their behalf on Lots offered subject to a reserve.

All descriptions are at the Auctioneer’s discretion
All items are sold on the basis of the buyer’s inspection. No guarantees or warranties are implied or given.
The highest bidder shall become the purchaser and NO PERSONS SHALL RETRACT A BID.
The Auctioneer reserves the right to refuse any bid.
Should any dispute or difficulty arise between two or more bidders, or otherwise, the lot or lots in dispute may be put up again or the purchaser declared, at the discretion of the Auctioneer, who are to be the sole arbitrators as to the amount of bidding, and every other matter connected with the sale; and their decision on each and every point in question shall be final and binding on all parties.
Descriptions are an expression of opinion after research and careful consideration. The descriptions are not intended to be a guarantee of authenticity. The Auctioneer will not be responsible for the correctness of the description or measurement or weight or genuineness or authenticity of any article they believe to be correct but are made as an expression of opinion only and the lots are sold subject to all faults and errors in description. Neither The Auctioneer nor sellers make any warranty to buyers in respect of the lots and any implied conditions or warranties are excluded except in the case of the seller those implied in section 12 of the Sale of Goods Act 1893 as amended by the Supply of Goods (Implied Terms) Act 1973.
The vendor authorises The Auctioneer to deduct commission and expenses at the agreed rates from the hammer price.
Bidders are to pay down immediately the whole of the purchase money.
On failure of compliance with the sale conditions. The Auctioneer shall be at liberty to resell the lot or lots without further notice, either by public auction or private sale, and the deficiency (if any) arising from such second sale, together with all charges and expenses attending to the same, shall be made good by the defaulter at this present sale, and be recovered as and for liquidated damages.
Defaulters will be unconditionally barred from any future sale.

**All lots shall be at the sole risk and charge of the purchaser from the fall of the hammer and such lots to be taken away with all faults, defects and errors of description, of whatsoever nature, sort or kind without any power of dispute, at the risk and expense of the purchaser - the purchase money to be paid on or before delivery; and no purchaser shall be entitled to remove any lot until he or she has paid for the WHOLE of the lots purchased.
Removal of lots can only be done after settlement of accounts and after the sale.
Removal during the sale will only be permitted if convenient for The Auctioneer.

The Auctioneer will be pleased to execute bids free of charge for anyone unable to attend the sale, on receipt of written instructions. Commission bid forms are available on request.
Commissions for the same amount on any one lot will be executed in order of receipt.

***The buyer is deemed to have accepted these conditions of sale and notices by making a bid.

****English Law shall govern the sale of each lot in every respect.


Use and storage of customer data
The information captured about our customer's name, address and contact details including email, is stored on an electronic back office system which is run by Easyliveauction.
Grove Mill Auctions and Easyliveauction do not share any of our customer personal information with any third parties and simply use it to process receipts of purchasing and selling history.
Printed receipts of customer transactions are securely stored by Grove Mill Auctions for 7 years during this time HMRC have the right to view any of this paper work for VAT purposes.
All customers have the right to request the removal of their data from our system. If any customers have any queries or concerns about the use and storage of their data please contact Grove Mill Auctions on 01257 793930.
