Every person on NALC Ltd premises at any time shall be deemed to be there at his or her own risk. He or she shall have no claim against NALC Ltd in respect of any accident which may occur, or injury, damage or loss howsoever caused.



2. In these conditions NALC AUCTIONS, who act only as auctioneers and agents for the vendor, are called “The Auctioneers”, and the representatives of NALC AUCTIONS conducting the auction is called “The Auctioneer”.


4. NALC Auctions make every effort to ensure the accuracy of their catalogue and the description of any lot:

4.1. Each lot as set out in the catalogue or as divided or combined with any other lot or lots is sold by the vendor with all faults, imperfections and errors of descriptions.

2. Nalc Auctions do not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot, unless they have been instructed in writing by the vendor so to certify, and in such case the Auctioneers do so as agents of the vendor and are not themselves responsible for such claims.

3. All statements, whether printed in the catalogue or made orally, as to any of the matters set out in (2) above are statements of opinion only and are not to be taken as being or implying any warranties or representations of fact by Nalc Auctions Ltd, unless they have been instructed in writing by the vendor so to certify, and in such case the Auctioneers do so as agents of the vendor and are not themselves responsible for such claims.

4. Any claim under any Statute must be received in writing by the Auctioneer within five days of the day of the sale.

5. In all cases Nalc reserves the right to perform an ‘Anti Money Laundering’ check on all new clients, it is incumbent upon the client to provide sufficient information to facilitate this search. NALC Ltd reserve the right to refuse new clients based on the results of this search without in any case giving any reason or without notice.


5.1. The Auctioneer has absolute discretion to divide any lot, to combine any two or more lots or to withdraw any lot or lots from the sale, to refuse bids, regulate bidding or cancel the sale without in any case giving any reason or without previous notice. He may bid on behalf of the vendor for all goods which are being offered subject to reserve or at the Auctioneers discretion.

2. The highest bidder shall be the buyer except in the case of a dispute. If during the auction the Auctioneer considers that a dispute has arisen, he has absolute discretion to settle it or to re-offer the lot. The Auctioneer may at his sole discretion determine the advance of bidding or refuse a bid.

3. Each lot is put up for sale subject to any reserve price placed by the vendor. Where there is a reserve price, the Auctioneer may bid on behalf of the vendor.

4. All conditions, notices, descriptions, statements and other matters in the catalogue and elsewhere concerning any lot are subject to any statements modifying or affecting the same made by the Auctioneer from the rostrum prior to any bid being accepted for the lot.

6. RESCISSION – In respect of art and antiques

6.1. Notwithstanding any other terms of these Conditions, if within five days after the sale NALC Auctions have received from the buyer of any lot notice in writing that in his view the lot is a deliberate forgery that differs from the catalogue description and within fourteen days after such notification the buyer returns the sale to NALC Auctions in the same condition as at the time of sale and by producing evidence, the burden of proof to be upon the buyer, satisfies NALC Auctions Ltd that considered in the light of entry in the catalogue the lot is a deliberate forgery, then the sale of the lot will be rescinded and the purchase price of the same refunded.


1. In the event of a sale by private treaty both the vendor and the buyer agree to be bound by the General and any Special Conditions of Sale.



9. 1. All goods delivered to NALC auctions saleroom or Sale Ground premises will be deemed to have been delivered for sale by auction unless previously stated in writing and sold at the discretion of NALC Auctions Ltd in a capacity as auctioneers and they will be deemed to have been accepted by NALC Ltd for sale subject to the Conditions of Sale as displayed at the Saleroom or within the catalogue supplied with the entry form of items entered off the saleroom premises, or such variation thereon as may from time to time be announced. Delivery of the goods to and NALC Auction by and on behalf of a vendor shall be deemed to represent acknowledgement that he or she has accepted and agreed to be bound by the said Conditions of Sale.

2. NALC Ltd reserve the right to refuse entry of items deemed to be unsaleable, unfit for purpose or below standard.


NALC Ltd hereby disclaim all responsibility for loss or damage to goods or for unauthorised removal of goods and for damage to premises caused by the contractor who may be used by the auctioneers or the buyer; who should be insured for such risks. Unless instructions are received to the contrary the charge for these services will be deducted from the proceeds of the sale.


NALC Auctions Ltd disclaim all responsibility for loss or damage to goods or for unauthorised removal of goods unless caused by the direct negligence of their employees.


NALC Ltd reserve the right to sell/store or arrange for sale/storage of goods delivered to them for sale either on their own premises or elsewhere at their discretion. They exempt themselves from any liability for loss or damage to goods delivered to their saleroom or sale Ground without sufficient sale instructions and reserve the right to make a minimum storage charge at £5.00 plus VAT per lot per day for such goods. .


Vendors will be charged for goods left on the premises if the vendor has been requested to remove them and if the goods are not removed by 5pm on the Friday of the week following the sale NALC Ltd reserve the right to sell the goods to cover costs and storage charges or dispose of the goods if they are of no saleable value and charge the owners of the goods for disposal.


If before NALC Ltd remit the “sale proceeds” to the seller, the buyer makes a claim to rescind the sale under the Terms & Conditions of Sale if appropriate and NALC Ltd are of the opinion that the claim is justified, NALC Ltd are authorised to rescind the sale and refund to the buyer any amount paid to in respect of the lot.


If lots offered for sale by NALC Ltd fail to sell, the seller shall decide either to re-offer the lot for sale if deemed suitable for re offer by the auctioneers or to collect the lot. If the vendor so wishes.


1. All goods are put up for sale without reserve at the Auctioneer’s discretion unless clear written instruction on an entry form as to reserves are received by NALC Ltd prior to the commencement of the sale.

2. Reserves below £50 will only be accepted at the Auctioneers discretion and in any event no responsibility will be undertaken for such reserves below £50. In all cases the Auctioneer reserves the right to sell within 10% of the reserve price.

3. The Auctioneers reserve the right to sell without reserve any item that has failed to reach the reserve price and has not been removed by the vendor. Reserved items may be re-entered at the sole discretion of and by agreement with the auctioneers.

4. The Auctioneers reserve the right to dispose of any lot that fails to attract a bid and to charge the vendor for such disposal unless they are collected within five days of their first offering for sale.


The vendor shall duly indemnify NALC Auctions Ltd against any claims in connection with any goods sold by NALC Auctions on the vendor’s behalf.

No warranty whatsoever is given on electrical and gas powered goods and it is the buyer’s responsibility to ensure that an appropriate electrical or gas test is undertaken by a suitably qualified technician prior to use.

The seller of electrical or mechanical goods warrants and undertakes to the auctioneers that at the date on which the same are consigned to the care of NALC Auctions except where previously disclosed to NALC Auctions the same are safe if reasonably used for the purpose for which they were designed and free from any defect not obvious on external inspection which could prove dangerous to human life or health and will indemnify NALC Auctions Ltd, its servants and agents against any loss or damage suffered by any of them in consequence of any breach of the above warranty and undertaking. Furthermore, all electrical goods will be sold electrically untested and cables severed where deemed necessary by the auctioneers.


The vendor gives NALC Auctions Ltd full and absolute right to photograph and illustrate any lot placed in its hands for sale and to use such photographs and illustrations any photographs provided by the vendor at any time at its absolute discretion (whether or not in connection with the auction).


1. NALC Auctions Ltd undertakes to pay the vendor the proceeds of sale, less commission, and other notified deductions, as displayed, irrespective of whether payment has been received from the purchaser.


In the event of a vendor withdrawing a lot the Auctioneers reserve the right to charge full commission at the Auctioneer’s estimated value of the lot. The Auctioneers reserve the right to exercise a lien on items until such payment is made


Where the vendor is registered for VAT purposes and enters any goods for Sale which are not technically household chattels, we are obliged by law under these circumstances to charge VAT at the prevailing rate and in addition to the Sale price as knocked down. This tax will be paid to the Vendor who will be obliged to account to the Customs & Excise office. This information must be supplied to the Auctioneer on or prior to delivery of the goods.


Fees apply to the hammer price:
14% Plus Vat on all lots within this sale.


Each buyer on making a bid for a lot acknowledges that he has satisfied himself fully before bidding by inspection or otherwise as to all the Sale Conditions the physical condition of and description of the lot including but not restricted to whether the lot is damaged or has been repaired or restored.


Legal title will not pass to the buyer until the lot(s) has been paid for in full and the Auctioneers shall be entitled to a lien on any lot sold until the purchase price (as defined below) is paid in full but each lot is at the sole risk of the buyer from the fall of the hammer. Each buyer shall forthwith give his full names and permanent address and if called upon to do so by the Auctioneer shall forthwith pay to NALC Ltd such proportion of the purchase price as the Auctioneer may require. If the buyer fails to do so, the lot may at the Auctioneer's discretion be put up again and re-sold. The buyer will be liable to pay any loss on the resale on such items


Every bidder shall be deemed to act as principal unless there is in force a written acknowledgement by Auctioneers that he acts as agent on behalf of a named principal.


1. No purchase shall be claimed or removed until it has been paid for and the sale has been concluded. All purchases shall be paid for and removed at the buyer's risk and expense by the end of the second working day after the sale, failing which the Auctioneer shall not be responsible if the same are lost, stolen, damaged or destroyed, and all lots not so removed shall remain at the risk of the buyer and subject to a minimum warehousing charge of £5.00 per lot per day plus VAT. If they are not paid for and removed within seven days of the sale the Auctioneer may re-sell them by auction or privately without notice to the buyer.

2. In the event of any failure of the buyers to comply with any of the above conditions the damages recoverable by the seller or the Auctioneers from the defaulter shall include any loss arising on any re-sale of the lot, together with the charges and expenses in respect of both sales, and together with interest at 2% above Base Rate upon the price of any lot which has not been paid for within 48 hours of the sale, and any money deposited in part payment shall be held by the Auctioneers on account of any liability of the defaulter to them or to the seller. The Auctioneers are unable to accept payment from successful bidders other than bank transfer, debit card or cash in pounds sterling. The Auctioneers reserve the right to refuse payment by any other means.


1. The purchaser of any lot shall pay the hammer price plus a premium (together with VAT on the premium for all lots and on the hammer price if applicable to that lot). The premium shall be calculated at 13% (plus VAT) on the hammer price of each lot. The premium at the appropriate rate is payable by all purchasers. The vendor authorises the Auctioneer to deduct commission and expenses at the agreed rates from the hammer price and the purchaser and the vendor acknowledge NALC Auctions Ltd’s right to retain the premium payable by the purchaser.

2. Not only will any bidder or purchaser at any sales be deemed to be purchasing, or to have purchased, in full knowledge of, and agreement with, these and any other printed or announced conditions of sale, he will also be deemed to be in full knowledge of, and agreement with, such other conditions of sale as are on display during normal office hours in the offices of the Auctioneers.

4. If the auctioneer finds it necessary to use solicitors or other professional parties to recover any outstanding accounts or any other charges or expenses, the purchaser will, in addition, be required to pay for such costs incurred and shall indemnify the auctioneer in respect of the same.

5. Should an account or any other charges or expenses not be paid on its respective due date, then the auctioneer will be entitled to damages as set out as compensation in the Late Payment of Commercial Debts (Interest) Act 1998 and contractual interest pursuant to said Act or any successor legislation, from the day of sale until settlement. If the said Act does not apply as the purchaser is a consumer then the auctioneer reserves the right to charge interest at the rate set out in said Act (for the avoidance of doubt interest may be charged at 8% above the Bank of England base rate during the period in which the account and/or any other charges or expenses are due).

6. Online Internet bidding – any purchaser bidding online needs to satisfy themselves with the terms, conditions and charges of the internet auction site provider. These terms, conditions and charges are in addition to those levied NALC Auctions Ltd. When an online bid has been made using the internet providers site it cannot be rescinded unless a genuine dispute is identified by the buyer. The buyer needs to be aware that pressing the bid button on the internet providers site will enter them into a fully binding contract in relation to the item that the bid was entered on should that bid be successful. It is the buyer’s sole responsibility to ensure that they are bidding on the correct lot. It is the buyer’s responsibility to ensure that they are accepting the current bid price before they press the online bid button


1. The right is reserved to refuse admission to the saleroom or sale ground premises and any used by the auctioneer at his or her sole discresion without giving a reason.

2. Any person bringing onto any premises used by NALC Group Ltd any hazardous substances must provide the relevant information for use by the Auctioneers, members of the public and prospective purchasers. Vendors of all goods are reminded of their duty to comply with relevant Health & Safety Acts. Purchasers are reminded that any second-hand goods purchased through an auction sale should be thoroughly checked by a competent person before use.


1. At all times prior to the fall of the hammer chattels remain the responsibility of the vendor and thereafter the responsibility of the purchaser at no time other than when due care is expected of an agent do auctioneers accept responsibility.

2. For the avoidance of doubt. The insurance of chattels is always the duty of the owner.


The estimated selling price for each lot is available upon request. The estimates are prepared well in advance of the sale and are not definitive and are subject to revision.


Buyers are reminded that storage charge of £5.00 plus VAT per lot per day will be levied on all lots that are not collected in accordance with the Conditions of Sale.

32. BIDS

We will be pleased to execute bids on behalf of intending buyers, and no charge is made for this service. Lots will be purchased as cheaply as permitted by other bids and reserves. Bids must be submitted to the Office at least two hours before the sale commences and should be entered on the form provided. Bids left by telephone will be accepted only on the condition that they are at the sender's risk and must in any case be confirmed in writing.


Payment must be made by the end of the next working day following the sale in which the goods have been purchased.


If you would like an opinion on the condition of any lot prior to purchasing, or if you are unable to attend the sale and would like a condition report please request this and we will send a written condition report by email. No verbal condition reports will be given. The auctioneers accept no responsibility for any error or difference of opinion on any report given as they are given as guidance only.

Farm and dispersal sales

LOADING FACILITIES – Loading facilities will be available upon request to the auctioneers . Loading outside these times will be strictly by arrangement with the Sellers. Any lots remaining after two weeks post the auction date will be re-sold (see section 12 of the Conditions of Sale).

The Auctioneers and Seller will not accept any responsibility or liability for the loss or damage to lots left on the sale ground and all Buyers are reminded that they are entirely responsible for any lot purchased from the fall of the hammer.

Vehicles entering the sale ground for loading must operate below a 5mph speed limit and move with caution.

BUYER’S FACILITIES – All registrations for this Online or Timed Machinery Auction are provisional and subject to the approval of the auctioneer. Your Highest Bid will be treated as a valid bid even if at the time of placing it the RESERVE is NOT MET. Sellers may ask us to reduce the reserves in the closing hours and put items on sale. Remember when placing a bid you are bidding to buy. Details are provided in good faith. They should not be relied upon as fact and buyers must make their own investigations.

Where measurements, mileages, hours, condition or authenticity are critical. Buyers should make themselves satisfied they are happy with the lot before they bid as viewing is available on all lots by prior appointment, all bids are non-retractable.

Potential buyers who do not inspect lots prior to bidding, do so at their own risk. The condition and function of an item should be confirmed by the bidder, prior to bidding. As there will be NO refunds or allowance given after the closure of the bidding process or fall of the hammer.. Your bid is your commitment to purchase.

Any Transgression of these rules will be reported to or and the bidder will be blocked from taking part in any future NALC Auctions

No warranty is offered or implied. Each lot is bought and sold as seen. Viewing is welcome and recommended. If a bid is placed during the last 3 minutes of a lot’s closing time then the closing time is updated to end approximately 3 minutes from when the bid is placed.

VAT - VAT will be payable on all lots in addition to the hammer price, buyers premium and internet surcharge at the standard rate.

CONDITIONS of sale - The sale will be conducted under our standard Conditions of Sale reproduced in this catalogue. All prospective Buyers should ensure that they have read and understood these Conditions. The act of bidding will be taken as acceptance of them.

ENGINE HOURS - Neither the Sellers nor the auctioneers make any warranty regarding engine hours or vehicles mileages.

INSPECTION OF EQUIPMENT – No powered machinery or equipment may be started without the prior approval of the auctioneers representative during the viewing days.

CATALOGUE ENTRIES - Whilst every attempt is made to ensure that the descriptions are accurate, no guarantees are either given or implied. Buyers should be aware that from time to time, lots are withdrawn and other lots added. Please contact the auctioneers prior to the online sale or viewing days commencing to ensure that the machinery has been delivered onto the sale ground.

Overall Condidtions of sale

(i) In these conditions the following terms have the following meanings unless inconsistent with the context: “Auctioneers” means NALC Auctions –“Host” means The host website portal for this auction;
(ii) “Internet Surcharge” means the surcharge charged to the Purchaser on purchased Lots;
(iii) “Conditions” means the standard terms and conditions of business set out in this document; “Lots” means all or any machinery and other items sold or intended to be sold in accordance with these conditions; “Purchaser” means a person, firm or Company who purchase any Lot; “Vendor” means a person, firm or Company who puts forward any Lot intended to be sold at the sale; “
(iv) Sale” means a sale of the Lots by auction from time to time organized by the auctioneers;
(v) “Saleground” means the venue at which the sale takes place; “Sale price” means the price at which a Lot is sold to the winning Purchaser; and
(vi) “Reserve Price” means the minimum price fixed by either the Auctioneers or Vendor at which any Lot is to be sold at the sale. (ii) Except where the context otherwise requires words denoting the singular include the plural and vice versa.
(vii) Words donating one gender includes all genders, words denoting persons include corporations. 2 CONDITIONS OF SALE (i) All persons registered to bid at the Sale in any capacity are deemed to bid on the understanding that they have read and understood these Conditions. (ii) These Conditions may be supplemented or superseded by special conditions applicable to specific Sales, any such special conditions will be noted within the descriptions of specific lots. (iii) These Conditions, the sale of the Lots and the participation in the auction are on the basis that the Purchaser is acting wholly or mainly within the Purchaser’s trade, business, craft or profession.
(viii) HEALTH AND SAFETY (i) All persons viewing a lot do so at their own risk and with notice of the condition of the premises and their contents. (ii) All persons viewing a lot are hereby made aware that there may be significant risks on the Sale ground including moving machinery and equipment; (iii) Caution should be exercised at all times and children and animals/pets must be fully supervised at all times. (iii) All persons viewing a lot must take notice of all specific health and safety notices on display. If in doubt, please consult the Auctioneers in charge. (iv) Any accidents or incidents that occur on the Sale ground must be immediately reported to the Auctioneers and details recorded in the appropriate accident book.
(ix) No powered machinery or equipment should be started without the prior approval of the Auctioneers. (v) Any vehicles brought onto the Sale ground to collect lots should be operated with extreme caution and within a 5mph speed limit.
(x) Loading using machinery should only be undertaken by suitably qualified and experienced operators. (vi) The Auctioneers shall have the right at their discretion to refuse admission to their premises or those of their clients by any person.
(xii) 4 AUCTIONEERS STATUS (i) The Auctioneers sell as agents for the Vendor except where they are stated wholly or partly to own any Lot as principal. (ii) The parties to the contract of sale are the Vendor and the Purchaser.
(xiii) The Auctioneers are not responsible for any default by Vendor or Purchaser. (iii) The Auctioneers includes any employee or agent of the Auctioneers who at the relevant time has the authority to conduct an auction sale.
(xiv) LIMITATION OF LIABILITY (i) This clause 5 sets out the entire financial liability of the Auctioneers (including any liability for the acts or omissions of its respective employees, agents and subcontractors) for: (a) any breach of these Conditions however arising; (b) any use made or resale of the Lots by the Purchaser; and (c) any representation, statement or tortious act or omission (including negligence) arising under or in connection with these Conditions. (ii) Nothing in these Conditions shall limit or exclude the Auctioneers liability for: (a) death or personal injury resulting from negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded or limited by applicable law. (iii) Without prejudice to clause 5(ii), the Auctioneers shall not under any circumstances whatever be liable to the other, whether in contract, tort (including negligence) or restitution, or for breach of statutory duty or misrepresentation, or otherwise, for any: (a) loss of profit; (b) loss of goodwill; (c) loss of business; (d) loss of business opportunity; (e) loss of anticipated saving; or (f) special, indirect or consequential damage, suffered by any other party that arises under or in connection with these Conditions. (iv) Without prejudice to clause 5(ii) or clause 5(iii), the Auctioneers total liability for all other losses arising under or in connection with these Conditions, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the Reserve Price.
(xv) (v) The Purchaser acknowledges that the Vendor has given the Purchaser a reasonable opportunity to inspect the Lots, and the Purchaser has satisfied itself as to the quality and condition of the Lots.
(xvi) 6 WARRANTY DECISIONS In case of dispute as to the interpretation of these Conditions the decision of the Auctioneers shall be final and binding on all parties save as provided for in clause 15(iv).
(xvii) 7 RESERVATIONS The Auctioneers sell as agent for the Vendor and as such are not responsible for any default by the Vendor or Purchaser.

Property Auction Terms.

For the avoidance of any doubt. These terms and conditions are in addition to those which are printed in the property auction Catalouge.

Please note: payments will only be accepted via Bank Transfer or (if you are in person/face-to-face transactions) Debit or credit card may be taken for lots. For the foreseeable future (covid 19 regulations) payments are to be arranged over the phone to head office on 01636 558200 or the London office on 02070 789755.

1: The Buyer is deemed to have accepted these conditions of sale and Notices by the making of any bid.

2: The highest bidder shall be the buyer at the Hammer price and the dispute shall be settled at the auctioneer’s absolute discretion. The auctioneer shall have the right to determine the advancement of the bids. The auctioneer reserves the right to refuse any bid and of altering, adding to dividing, consolidating, or withdrawing any Lot or Lots at the sale or bidding on behalf of the vendors.


The Auctioneer shall be the sole arbitrator to every matter connected to the sale and their decision on each and every point in question shall be final and binding on all parties.

3: NALC Auctions will not be responsible for the correctness of the description or measurements whilst believed to be correct descriptions are made as an expression of opinion only and all Lots are sold subject to all faults and errors in description Neither the Auctioneer nor the sellers make any warranty to a buyer's in respect of the law.

4: Buyers shall give on request, their names and places of abode and /or business and to pay at the fall of the hammer the whole of the purchase money or such deposit as the auctioneer may require.

Online Bidding

When your Lot comes up, the screen will allow you to enter bids in your selected manner. The current and upcoming lots are displayed at the bottom of the screen.
This is a live auction and you will be bidding against others in the room, written bidders, and others online. Submitted bids will be seen by the auctioneers, and you will be notified on-screen if your bid is accepted.

The buyer understands that if I am the successful bidder I hereby undertake to immediately pay the Deposit and Buyer's premium. NALC Auctions are duly authorized to sign the Memorandum of sale on my behalf. Thereafter I understand that in an unconditional auction I will have to complete the purchase within 28 days from the date mentioned on the memorandum of sale.
I confirm that I have read and understood the Legal pack and agree to any special conditions within the Legal pack. Certified copies of my passport and unity bill have been or will be provided to the auctio9n department.

Enter bids in your selected manner. If the auctioneer asks for a bid in a certain increment (amount). Try to go with him if you can.

I confirm that I have read and understood the Legal Pack and agree to any special conditions within the Legal Pack. Buyers should be happy to provide Certified Copies of their passports and utility bill as and when required.

Terms and Conditions

The Bidder appoints NALC Auctions as an agent and authorizes NALC Auctions to bid for the relevant Lot on behalf of the Bidder in such manner as NALC Auctions thinks fit in its absolute discretion. The Bidder may withdraw London City Auctions authority to bid if the withdrawal is in writing and is received by the Auctioneer before the Auction commences and the Auctioneer confirms to the Bidder in writing that the withdrawal instruction has been received.
1. These terms and conditions apply to you and you will be bound by them if you bid by telephone, via the internet, or absentee/proxy.
2. Definitions used in these terms & conditions:
The approved financial institution has the same meaning as in the RICS Common Auction Conditions Edition 4.0 November 2018.
Auction means the NALC Auctions / Auctions to be held at the time and place and on the date advertised in any format by NALC Auctions in which the Lot appears.
Auctioneer means the NALC Auctions auctioneer has conducted the Auction.
Bidder means the party bidding for the Lot and who acts as the buyer and guarantees the performance of the buyer under the Conditions of Sale.
Business Days has the same meaning as in the RICS Common Auction Conditions Edition 4.0 November 2018.
Buyer means the person, firm, or company identified on the Registration Form who agrees to buy the Lot.
Conditions of Sale means the auction conduct conditions together with the general conditions of sale, any special conditions of sale, and any addenda that are applicable and/or relevant to the Lot.
Lot means the property for which you bid remotely at the Auction.
Maximum Bid Price means the maximum price that you wish to bid for the Lot. This must be shown exclusive of any VAT that may be applicable.
Registration form means the registration form for remote bidding contained NALC Auction Catalogue or sent to you by email.
Seller means the person selling the lot.
VAT means value-added tax or any other tax of a similar nature.
3. Registration form
• If you wish to bid at the Auction by telephone, via the internet, or absentee/proxy you must complete the Registration form by entering your full details as the Bidder and full details of the Buyer if different from the Bidder. You should sign the Registration form where indicated.
• The completed Registration form should be sent to NALC Auctions so that it is received not less than two clear Business Days prior to the date of the Auction, together with: Two forms of identification for you consisting firstly of a form of photo identification such as your passport or current driving license and secondly proof of your address such as a recent utility bill or bank statement. To comply with the Money Laundering Regulations, if you are not the Buyer we will require you to provide further documentation.
• If you wish to alter any of the details appearing on the Registration form, you must notify the Auctioneer of this in writing before the Auction commences. Alterations will only be effective if the Auctioneer confirms to you in writing that the request to alter has been received.
4. In the event that the Auctioneer considers that there is any error or confusion about the Registration form or the deposit, the Auctioneer reserves the right not to accept your bid. Please note that the Auctioneer’s decision as to what constitutes error or confusion is final.
By completing this Registration form you warrant that there are adequate funds in the account to meet the full amount of the deposit
5. Deposit
1. The deposit is to be paid immediately after the auction and no later than 15:30 on the day following the auction by bank transfer to London City Auctions client’s account in sterling on an Approved financial institution for a sum representing the greater of:
a. The minimum deposit of £5,000 plus VAT (or the total of your maximum bid price if this is less than that minimum)
b. 10% of the Maximum Bid Price exclusive of VAT.
2. If you are the successful bidder NALC Auctions requires a separate payment of £850 PLUS of VAT as a buyer's administration fee payable to London City Auctions Limited to be electronically transferred immediately after the auction and no later than 15:30 on the day following the auction. On exchange of contract for each lot purchased.
A VAT receipt will be provided upon payment.
6. Absentee/Proxy Bids
• If you bid at the Auction by Absentee/proxy you should enter your Maximum Bid Price on the Registration form.
• The Maximum Bid Price must be an exact figure. Failure to clearly indicate your Maximum Bid Price will invalidate your bid.
• If you bid by absentee/proxy you appoint the Auctioneer as your agent and you authorize the Auctioneer to bid for the Lot on your behalf up to (but not in excess of) your Maximum Bid Price in whatever manner the Auctioneer in his absolute discretion thinks fit.
• As soon as reasonably practicable after the Auction you will be notified as to whether or not your absentee/proxy bid for the Lot was successful.
• The amount of your Maximum Bid Price for the Lot will not be disclosed by the Auctioneer to the Seller
7. Terms of Sale/Conduct of Auction
• you shall be deemed to have read the “Important Information for Bidders” on the Auctioneer’s website/ catalogue and the ‘Common Auction Conditions, the special conditions of sale, and any addendum’ relating to the Lot. You shall be deemed to have taken all necessary professional and legal advice and to have made all your inquiries and to have knowledge of any Auctioneer’s announcements that are relevant to the Lot.
• It is possible that at any time up to the commencement of bidding at the Auction amendments and/or additions may be made to the Conditions of Sale for the Lot or any other matters relating to it. Such amendments are published by means of written addenda and by verbal addenda announced from the rostrum. You will be deemed to have knowledge of such matters (including for the avoidance of doubt any late addenda that are announced verbally from the rostrum) and if your bid is successful you will buy subject to them.
• If your bid is successful the Auctioneer or any person authorized by the Auctioneer will sign the memorandum of sale and any other relevant document relating to the Lot on your behalf and as soon as the deposit is cleared send this to you by post.
• In accordance with the Common Auction Conditions and in particular clauses A5.5 and A6.5, if you are the successful bidder, you will be required to complete the (‘NALC Auctions Customer Due Diligence Form’) and provide the information stated. You will be deemed to have read the ‘Requirements for bidders and buyers under the Money Laundering Regulations and will fully comply with them. Both documents are on the NALC Auctions catalogue.
8. Disclaimer
NALC Auctions or any employee or agent of NALC Auctions or the Auctioneer will have no liability or responsibility whatsoever towards you or the Buyer in the event of your bid not being made as a result of:
• Unclear instructions.
• Error, lack of clarity, or confusion whether during the Auction or regarding the Registration form or the deposit.
• Any change in the date, time, and/or venue of the Auction.
• Any interruption or suspension of telephone or internet bidding services.
• You being unobtainable by telephone or becoming disconnected during the course of bidding by telephone or via the internet.
• Any other factor beyond NALC Auctions control.

Please complete the online registration form and submit it to NALC Auctions no later than 2 working days prior to the date of the auction. You WILL NEED TO RECEIVE WRITTEN CONFIRMATION FROM LCA THAT YOUR REGISTRATION TO BID HAS BEEN COMPLETED SUCCESSFULLY

Payment in respect of the Deposit (10% of the maximum bid) and the Buyer’s Premium plus VAT must be paid in advance of the auction. Or at the latest within 48 hours of your successful online bid. Pre-Payment to unsuccessful bidders will be electronically refunded after the auction. Bidders must contact NALC Auctions the day following the auction to arrange repayment.

Buyer’s Premium:
Applies under the fall of the hammer. The purchaser shall pay a 10% deposit. Plus, in addition, the buyer’s premium of A minimum of £3000 +VAT or 2% of the sale price, whichever is the greater upon exchange of the contract.

(After the Online Auction)
If Successful, the auctioneer will complete the memorandum of sale on the buyers behalf immediately post auction.

The auctioneer will provide a hard and soft copy of the exchanged contract to both parties within 24 hours post auction

The auctioneer shall account out to all parties the balance of their deposit and /or outstanding balance with 5 days post auction.

All buyers shall be obliged to pay the NALC Auctions Buyers administration fee of £850+VAT on the exchange of contacts for each lot purchased.

Commission Rates & Charges.

2% + VAT
Subject to a minimum charge of £3000 + VAT per lot when sold.. or 2% of the sale price, whichever is the greater.

15: If the lot has been sold, We recommend it should be insured at the fall of the hammer prices against loss as a result of theft, fire, flood, or negligence. Responsibility to insure is that of the buyer at the fall of the hammer.
