Standard Terms & Conditions Inverness Auction Centre Limited by which carries on business with buyers and Sellers in the Auction premises and Online Bidding
In these terms of Business Inverness Auction Centre Ltd referred to as Inverness Auction Centre
In these Conditions: "auctioneer" means the firm of Inverness Auction Centre
“Hammer price” :- is the level of bidding reached at or above any reserve when the Auctioneer brings down the hammer.
“Terms of Contract” :- is the stipulated terms and rates of commissions on which Inverness Auction Centre accepts the instructions from seller or their agents.
“Total amount due” :- is the hammer price in respect of the lot sold, together with any premiums.
Value Added Tax is chargeable plus any other additional charges.
“ Sale Proceeds” :- this is the net amount due to the seller, being the hammer price of the lot sold less commission at the stated rate, plus any other fees due.
2. BIDDING PROCEDURES AND THE BUYER
Bidders are required to register their details before bidding and to satisfy any security arrangements before entering the auction room to view or bid.
Upon registration a Bidding Card must be purchased for the sum of £1 – which is refundable upon the return of the bidding card.
The highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute regarding the bid MUST be raised before the next lot is offered and shall be settled at the auctioneer's absolute discretion.
Once made - NO bid may be withdrawn.
It is our right to bid on behalf of a buyer up to the amount of the buyers reserve.
The right to refuse any bid is also reserved.
Inverness Auction Centre is not responsible any item once it leaves saleroom
Bidding increments shall be at the auctioneer's sole discretion.
4. THE PURCHASE PRICE
The buyer shall pay the hammer price together with a premium thereon of 16% plus the applicable rate of VAT
5. VALUE ADDED TAX
Value Added Tax on the hammer price as imposed by law on all applicable items.
Immediately a Lot becomes sold you will: -
Provide proof of identity if requested.
Pay to us the total amount due in cash or such other way as is agreed by us.
We accept cash, debit cards, credit cards, bank transfer (details available on request)
Debit and Credit card payments are only accepted if the buyer is present.
It is advised that payment is made immediately and that collection is swift as all goods are the buyer's responsibility from the point of sale.
Once you have paid or your funds have cleared and your goods are ready for collection you must give a copy of your receipt to a member of staff who will sign out your goods.
Online bidders will automatically be charged through their registered card for items they have won if they fail to make payment.
7. TITLE & COLLECTION OF PURCHASES
The ownership of any Lots purchased shall not pass to you until you have made payment in full to us for the total amount due.
You shall, at your own risk and expense take away any lots that you have purchased and paid for not later than 3 working days following the day of auction, unless by prior arrangement and providing that all payments have cleared our account.
After which you shall be responsible for any removal, storage and insurance charges.
A storage charge of £5 per day will be imposed 7 days after the date of the auction purchase.
8. NON PAYMENT OR FAILURE TO COLLECT PURCHASES
Any buyer who fails to make payment for items which they successfully bid upon on 3 separate occassions will be refused further registration for a bidding card.
9. THIRD PARTY LIABILITY
All members of the public on our premises are there at their own risk and must note the lay-out of the accommodation and security arrangements. Accordingly neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property or persons visiting prior to or at a sale.
10. COMMISSION BIDS
While prospective buyers are strongly advised to attend the auction and are always responsible for any decision to bid for a particular Lot and shall be assumed to have carefully inspected and satisfied themselves as to its condition, we will if so instructed clearly and in writing execute bids on their behalf.
Neither the auctioneer nor our employees or agents shall be responsible for any neglect or default in so doing or failing to do so.
Where two or more commission bids at the same level are recorded we reserve the right in our absolute discretion to prefer the first bid made.
Please note that any lots purchased by this service will be subject to an additional 3% commission charge at the rate imposed on the hammer price.
11. WARRANT OF TITLE & AVAILABILITY
All goods entered are at owners risk.
All goods entered are declared as belonging to you or you have the right to sell.
Reserve prices must be clearly marked on the entry form.
Unsold goods unless highlighted on the entry form will be re-entered for auction with no reserve.
Unsold goods must be collected within 7 days of the auction, failure to collect will result in storage charges being applied.
The auctioneer normally acts as agent only and disclaims any responsibility for default by sellers or buyers.
13. STANDARD SELLER CHARGES
You will pay 16% of the hammer price of each lot which sells, plus VAT, where applicable. Loss and Damage Warranty is 1% on value of lots sold. Plus a £0.50 pence per lot insertion fee will be applied, this will include photography and marketing, etc.
Inverness Auction Centre reserves the right to charge a Withdrawal Fee of up to 10% of the reserve or lower estimated selling price and to return any items to the Vendor at the Vendor's cost plus VAT where applicable, MINIMUM PAYOUT IS £2 SOLD AUCTION PRICE, items sold for less than £2 will not be paid out.
Vehicles entering the auction will be charged 12% of the selling price Plus VAT, in addition is the Loss and damage warranty of 1% on the value of the lots sold, plus and insertion fee of £0.50 per lot, for photography and marketing, proof of ownership and all vehicle documents must be supplied upon entering to the auction, in addition to a vehicle history check for outstanding finance and right off.
14. DESCRIPTIONS & CONDITION
Whilst Inverness Auction Centre makes every effort to describe lots accurately, it may be impractical for us to carry out on each lot.
Prospective buyers and any independent expert acting on the buyer's behalf are given ample opportunities to view and inspect before the sale and they must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, any representation or statement by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price is a statement of opinion only. Subject to the foregoing neither the auctioneer nor its employees or agent nor the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of Lots, express, implied or statutory are hereby excluded.
This Condition is subject to the next following Condition concerning deliberate forgeries. Private treaty sales made under these Conditions are deemed to be sales by auction for purpose of consumer legislation
Notwithstanding the proceeding Condition, any Lot which proves to be a deliberate forgery (as defined) may be returned to us by you within 14 days of the auction provided it is in the same condition as when bought, and is accompanied by particulars identifying it from the relevant catalogue description and a written statement of defects.
If we are satisfied from the evidence presented that the Lot is a deliberate forgery we shall refund the money paid for the Lot including any buyer's premium (but not the amount of any consequential loss, damages, expenses or interest) provided that (1) if the catalogue description reflected the accepted view of scholars and experts as at the date of the sale or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition.
We shall have the right at our discretion to refuse admission to our premises or attendance at our auctions by any person.
Special terms may be used in catalogue descriptions or particlar classes of items, in which case the description must be interpreted in accordance with any glossary appearing within the catalogue.
Buying we aim to make buying and selling through Inverness Auction Centre
a simple and enjoyable process.
Below you will find some useful information to help you but if you are unsure of any aspect then please do not hesitate to ask a member of staff for assistance.
Registration Prior to bidding all buyers must register to bid and obtain a Bidding Card number at the office.
For buyers who are unable to attend then confirmation of your name, address and contact telephone number must be supplied to our office.
There are four easy methods of bidding with Inverness Auction Centre.
Bidding in Person
After registration you will be given a Bidding Card number.
The Auctioneer will call out the lot number and bidding shall commence with preset increments.
Should you wish to bid you must raise your Bidding Card and continue bidding until the point where you are the highest bidder or you decide to stop, if successful the Auctioneer will note down your Bidding Card number.
In the case of a dispute with regard to price or buyer then this should be drawn to the Auctioneer's attention prior to the offering of the next lot.
Leaving a Commission Bid
If you are unable to attend the auction then you can instruct Inverness Auction Centre to bid on your behalf.
This is known as a Commission Bid is a confidential service.
We accept Commission bids either by written instruction with the completion of a Commission bid form.
We shall then bid on your behalf up to the maximum level that you have set. All bids are dependent upon bidding activity in the room.
Lots will be purchased as cheaply as possible in line with room activity. In the event that two commission bids have been left for the same account, then priority will be given to the earliest bid received.
Registration for Commission bids must be made no later than 3pm on the day of sale.
Commission bids are charged an additional fee of 3% for this service.
With prior arrangement a telephone bid can be arranged with a telephone line booked on single or multiple lots.
A member of staff will call you from the Saleroom just before your lot number is offered for sale and you can then instruct us on a live telephone line to bid or to stop on your behalf.
We always ask that you leave us a main telephone number and a back up number in case of difficulties contacting you.
It is recommended that a covering bid be left in the unfortunate event that we are unable to make contact.
All telephone lines must be booked with us no later than 3:00pm on the afternoon of the sale.
Telephone bidding carries an additional fee of 3% for this service.
Online / Internet Bidding additionally all sales allow buyers the opportunity to bid from the comfort of their own home using our live online bidding service. EASYLIVE AUCTIONS
Any person using this service must have clearly read and understood our terms and conditions of shipping etc.
To register your Buyers Premium a premium of 16% of the hammer price is charged on all lots purchased at the auction. Plus an additional fee of 3%
If you are NOT PRESENT payment must be made via bank transfer, bankers draft or cheque. Our account details are available upon request.
Please note that if paying by bank transfer then you will need to quote your bidding number as a reference when sending payment.
All payments MUST be made within three working days of the sale and all funds must have cleared our account prior to collection.
20.COLLECTION OF GOODS
If you have paid for your purchases with cash, debit or credit card then collection can be made throughout the sale or within fthree working days of the sale, unless by prior arrangement.
21. PACKING & SHIPPING
We offer a limited shipping service within the UK and at the Auctioneer's sole discretion.
As we are restricted to what can be included in this service, it is advisable that you check with the office before bidding to obtain a possible quotation for the lots which you have expressed an interest.
The Auction is governed by the Condition of Sale. Please note that they can be amended by way of notice as posted on our website or by way of an announcement made by the Auctioneer.
The auction catalogues with images are available for each sale on our website and/or Facebook page, each lot is assigned a brief description and estimate are supplied.
Please note that the estimates are for guidance only and lots can sell above or below the guidline prices.
Public viewing takes place for several days prior to an auction. Please check out our website for viewing dates and times.
However, if you are unable to make these times and need to view, please just give us a call and we shall try our best to accommodate.
During the viewing days prospective buyers are invited and encouraged to inspect the lots and they must satisfy themselves as to the accuracy of any description.
All lots are sold as seen and their condition cannot be guaranteed.
Sometimes prospective buyers require further information and detail about lots, and we are happy to supply this along with extra photographs, etc.
Condition reports are solely based our opinion, we cannot be held liable if the condition is not as expected.
