Viewing
Viewing is by appointment on the Monday and Tuesday before the sale, and online at any time. Auction begins at 11am.

Buyers Premium
Each lot purchased is subject to a buyers premium of 15% + VAT at the prevailing rate.

Vatable Lots
Certain lots may be subject to VAT on the hammer price. This will be indicated in the catalogue with an *.

All buyers’ premiums are subject to VAT at the prevailing rate.

Bidding in the Room
We will require your personal / business contact details if you are the successful bidder. Law requires that sufficient I.D is provided by anyone making minimum cash payments of £9,000 (€15,000). This information is required under The Money Laundering Regulations 2003.

Absentee / Commission Bids
The Auctioneer will execute bids on your behalf if you are unable to attend the auction, purchasing the lot for you as cheaply as possible, depending on any other bids received and / or reserves. Completed bidding forms should be returned no later than 9am on the morning of the sale or handed to a member of staff at the saleroom before the start of the auction. Bidding forms are available from our Sevenoaks office.

We cannot accept responsibility for bids not received.

Telephone Bids
One of our staff will execute bids on your instruction by telephone if you are unable to attend the auction or require discretion.

Condition Reports / Images
We will be pleased to provide verbal condition reports and images by email where possible; in both instances we strongly recommend viewing in person.

We offer these reports in good faith.

Payment and Collection
Payment cannot be settled or lots collected until the auction has ended. Payments by cash and cheque with a valid banker’s guarantee card will be accepted. We also accept payment by debit and credit cards.

All won lots will be available for payment and collection following the sale. If you wish to collect after the day of the sale we will be open until 4pm for collection. However after this time and date an appointment will be necessary.

NOTICE
IBBETT MOSELY, for themselves and for the Vendors of each lot, whose Agents IBBETT MOSELY are, hereby give notice to persons taking part in all auctions that:-

(1) All statements contained in the catalogues or advertisements as to any lot are made without responsibility on the part of the vendors or the auctioneers.
(2) All statements contained in the catalogues or advertisements as to the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot are statements of opinion and are not to be taken as, or as implying, statements or representations of fact.
(3) The conventional descriptions used by some Auctioneers and Salerooms relating to Paintings, Drawings, Lithographs, Engravings and Prints are not followed in this Catalogue. No responsibility therefore can be accepted as to the description of Artists, Schools or Periods respecting Paintings, Drawings, Lithographs, Engravings or Prints and Purchasers must rely on their own judgment.
(4) Intending purchasers must satisfy themselves by inspection or otherwise as to all such matters and as to the physical description of any lot.
(5) Neither the vendor of any lot nor the auctioneers make or give, nor has any person in the employment of the auctioneers any authority to make or give any representation or warranty in relation to any lot.
CONDITIONS OF SALE BY AUCTION
I – The highest bidder shall be the Purchaser. If any dispute arises between the bidders, the lot to be put up again at the bidding immediately preceding dispute, or the Auctioneers may declare the Purchaser.
II – The advance in the biddings to be regulated by the Auctioneer, who is to be the sole arbiter in any matter of dispute. He also reserves to himself the right to refuse any bidding to withdraw, consolidate or divide any lot or lots, or to submit the lots in any order without regard to the position of the same, in the catalogue as may be deemed advisable. No bids or advance of biddings of less than £5. Some of the Lots are subject to reserve prices.
III – The Purchaser to pay (if required) a deposit of 25% as part payment, such deposit to be a general deposit on the whole or any of the lots of such buyers. Every Purchaser to give his name and place of abode.
IV – Each and every lot shall at the fall of the hammer be considered as delivered, and no lots or lot can be removed until the whole amount of the Purchaser’s account shall be paid in full, and payment is to be made to the person appointed to deliver.
V - The Auctioneers act as Agents only. Each lot as set out in the catalogue or as divided or joined with any lot or lots at the sale at the sole discretion of the auctioneers, is sold with all faults, imperfections and errors of description, and neither the vendor nor the auctioneers are responsible for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition of quality of any lot. All statements in the catalogue as to any such matters are statements of opinion, and are not to be taken as or as implying, statements or representation of fact. Purchasers are deemed to have satisfied themselves by inspection or otherwise as to all such matters and as to the physical description of any lot. Neither the vendor nor the auctioneers make or give, nor has any person in the employment of the auctioneers any authority to make or give, any representation or warranty and in any event neither the vendor nor the Auctioneers are responsible for any representation or warranty or for any statement in the catalogues.
VI – The lots to be paid for and cleared away after the sale has concluded or by appointment henceforth with all faults, imperfections and errors of description, and no allowance whatsoever shall be made. Any damage caused by removal, or otherwise, must be made good by the person committing the same; principals being considered responsible for the acts of their servants. N.B. – No lots will be cleared during the Sale.
VII – The Auctioneer reserves the right of making an allowance for the whole or any portion of a lot not delivered from any cause whatsoever – at the same time rate as to which such a lot was purchased; and inasmuch as IBBETT MOSELY act only as agents for the Vendor, they shall not be considered personally responsible for any default on the part of either Vendor or Purchaser. The Vendor reserves the right to bid by himself or his agent.
VIII – Any lots uncleared by the appointed time, agreeably with the condition will be forfeited, and may be resold or warehoused at the expense of the Purchaser; any deficiency arising from re-sale, together with warehouse charges and all attendant expenses, at £50 per day, shall be made good by the Purchaser.
IX – To prevent inaccuracy in delivery and inconvenience in the settlement of the Purchase, no lots or lot to be removed during the time of sale and no lot to be taken away without an order from the Auctioneers or their agents, and unless delivered by one of the Auctioneers’ porters
X – VAT – All bids shall be deemed to be inclusive of VAT where such tax is applicable.

LASTLY – On failure to comply with the above conditions, or non-performance of all or any part of them, the defaulters will lose their deposit, and the Auctioneer or Clerk of Sale shall be at liberty to take such steps as may be deemed necessary to bring the transaction to a close; and if a re-sale be affected, either by public auction or private contract, all loss and expenses shall devolve upon the defaulter at this sale. The Auctioneers will not be held responsible for damage or loss by accident or fire.

Particular attention is called to the Vlth Condition
Viewing: Purchasers are advised that viewing can only be permitted during the hours advertised.

Terms of Payment: By cash or card or Bank Transfer, Cheques will only be accepted from purchasers known to the Auctioneers, unless prior arrangements have been made with the Auctioneers. Monies held by Ibbett Mosely are held in ‘Ibbett Mosely Surveyors LLP Client Auction Account’ which is administered at NatWest Bank, 67 High Street, Sevenoaks, Kent TN13 1LA. This is a non-interest bearing account.

Complaints Handling Procedure: Ibbett Mosely operates an internal complaints handling procedure, copies of which are available upon request. Should matters remain unresolved beyond this internal mechanism, matters may be referred by either party to the Surveyor’s Ombudsman Service (for Consumers) or the Surveyor’s Arbitration Scheme (for businesses). Ibbett Mosely also have a HIP Redress Scheme which is administered by the RICS via the Surveyor’s Ombudsman Service by request of either party.
